Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the BalkanAds platform, services, and related websites (collectively, the “Service”). The Service is operated by Peak of Tech LLC (“BalkanAds”, “we”, “our”, “us”). By creating an account, funding credits, or launching campaigns, you agree to these Terms.

If you are using the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms. If you do not agree, do not use the Service.

• Advertiser: An account that purchases credits and runs campaigns on BalkanAds.
• Publisher: An account that provides ad inventory and receives payouts for valid delivery.
• Credits: Prepaid balance added via Paysera that can be spent on campaigns.
• Campaign: A configured set of ads, targeting, and budgets run through the Service.

• You must be at least 18 years old and legally able to enter into contracts.
• You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
• You must provide accurate information and keep it updated, including billing and payout details where applicable.

• The Service enables Advertisers to create and manage digital ad campaigns targeting regions, categories, and contexts across the Western Balkans.
• Advertisers fund their account by purchasing Credits via Paysera. Credits are consumed as campaigns deliver measurable results (e.g., CPM, CPC, CPA).
• Credits have no cash value, are not a deposit, and are usable only within the Service. Unused credits may be subject to local accounting and tax rules applicable to your entity.

• You are solely responsible for your ad content and landing pages. Content must comply with applicable laws, industry standards, and these Terms.
• Prohibited content includes, without limitation: illegal products, misleading claims, malware, hate speech, explicit adult content, and IP-infringing materials.
• We may review, approve, reject, or pause campaigns for any reason, including quality, safety, legal, or publisher policy concerns.

• Payments for credits are processed via Paysera. By funding credits, you authorize BalkanAds and Paysera to process the transaction.
• Pricing models may include CPM (per 1,000 impressions), CPC (per click), and CPA (per action). Actual spend depends on delivery and auction dynamics.
• All fees are exclusive of VAT and applicable taxes, which you are responsible for where required.
• Invoices and statements will be made available within your account, where applicable.

As the Service is digital, used or partially used credits are non-refundable. Refunds may be issued only if:

• A technical issue on our platform prevented a campaign from starting and no delivery occurred.
• A duplicate payment was made in error.

Approved refunds are processed to the original payment method via Paysera. See our separate Refund Policy for details.

• Publishers earn revenue for valid, measurable delivery in line with campaign settings and our verification standards.
• Payouts are made by bank transfer to the account listed in the publisher profile, subject to KYC/AML checks and minimum payout thresholds.
• We may withhold or adjust payouts in cases of invalid traffic, fraud, policy violations, or chargebacks.

• The Service, including software, designs, and trademarks, is owned by BalkanAds or its licensors and protected by IP laws.
• You grant BalkanAds a non-exclusive license to use your ads, marks, and creatives solely to deliver the Service.

We process personal data in accordance with our Privacy Policy. You are responsible for any notices and consents required on your properties (e.g., cookie banners, privacy disclosures).

• We strive for high availability but do not guarantee uninterrupted Service. Planned maintenance or emergencies may affect access.
• We may modify or discontinue features with or without notice, provided core contractual obligations are met.

• Accessing or using the Service for unlawful purposes.
• Interfering with or disrupting the integrity or performance of the Service.
• Reverse engineering or unauthorized scraping.
• Creating fraudulent accounts or engaging in ad fraud.

• We may suspend or terminate accounts for violations of these Terms, suspected fraud, non-payment, or legal requirements.
• You may close your account at any time. Outstanding balances are still due, and unused credits are handled per our Refund Policy.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee specific campaign outcomes, conversions, rankings, or revenue.

To the maximum extent permitted by law, BalkanAds shall not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, revenues, or data. Our aggregate liability for claims arising out of or relating to the Service shall not exceed the amounts paid by you to BalkanAds in the three (3) months preceding the event giving rise to the claim.

You agree to defend, indemnify, and hold harmless BalkanAds and its affiliates, officers, and employees from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your ads, content, campaigns, or violation of these Terms.

We may update these Terms from time to time. Material changes will be posted on this page with an updated “Last updated” date. Continued use of the Service after changes become effective constitutes acceptance.

These Terms are governed by the laws applicable to Peak of Tech LLC without regard to conflict of law principles. Disputes shall first be attempted to be resolved amicably; if unresolved, they will be subject to the exclusive jurisdiction of the competent courts of the company’s registered seat.
